What's New?

KING Launches Pilot Project

In the summer of 2010 KING launched a pilot project working with a rehabilitation company and five of our members.  The goal of the project is to create a sample set of good job descriptions for members that contain the physical demands of the essential job functions.  Secondly, the use of Functional Capacity Evaluations (FCEs) will be studied as it relates to post-offer pre-placement testing and return to work programs.  Uniform testing modalities will be established that members can use with their FCE provider or therapist.

Rehabilitation Specialists (OHS) has been selected work with our members to perform the physical demands analysis and distill the information for the creation of job descriptions.  In addition Rehabilitation Specialists will work with the FCE providers and gather data to help KING determine the efficacy and value of the testing.  KING members participating in the Pilot Project are Asbury Park, Brewster Place, Larksfield Place, Mt. Hope Nursing Center and Prescott Country View Nursing Home.

KS Supreme Court Ruling Will Increase Workers Compensation Costs
On September 4, the Kansas Supreme Court issued a ruling that could drastically increase the cost of workers compensation to Kansas employers. In summary, the Court ruled that the Kansas workers compensation statute does not contain a requirement that an injured worker make a “good faith effort” to seek post-injury employment to mitigate the employer’s liability. A copy of the Kansas Supreme Court ruling can be viewed HERE .

KING legal counsel Mike Entz has prepared a summary of the Court’s ruling and points for Kansas employers to consider in light of this decision titled “The Perfect Storm is Here”. This document can be viewed HERE.  The ruling will make the defense of work disability claims (involving “whole body injuries”) extremely difficult even when an employee is terminated for cause or the employee chooses not to return to accommodated work.  This issue will likely need a legislative remedy. Alert your elected representatives now. Stay tuned for more information and talking points as the next legislative session nears.

About KING

The Kansas Association of Homes for the Aging Insurance Group, Inc. (KING) is a group-funded workers compensation pool formed under Kansas statute 44-581. KING's formation began in the late 1980's in response to members' need when faced with shrinking insurance options and soaring worker compensation premiums.

KING is a non-profit 501 (c) 4 corporation that began offering workers compensation coverage to members on April 1, 1990. KING now insures between 65 and 70 KAHSA members generating over $3 Million in premium annually. KAHSA staff provides management services and oversight of the KING program.

KING Pays. Kansas statute allows group-funded workers compensation pools like KING to return unused premium in dividends to members that qualify. To date, KING members have received nearly $6 Million in dividends during the past 14 years. Annually, KING members that experience no claims or no indemnity claims are recognized during KAHSA's annual awards program.

KING's success is tied directly to loss control. KING provides members profesional loss prevention services tailor made to fit member needs. Services include in-service training, accident analysis and regional safety seminars.

KING members are leaders in safe working practices. Members who implement a "safe-lift" working environment receive a valuable premium discount. Over half of all KING members have a "safe-lift" designation.

KING Early Intervention program provides immediate nurse case management when necessary. This helps the injured employee receive the appropriate care as soon as possible and provides valuable communication to the member and claims adjuster. Each member's "return to work" program is analyzed and fortified so an injured worker can get back on the job quicker.

KING members submit reports of injury electronically to our claims administrator. An online menu of member specific reports is available as a tool to help analyze and proactively respond to incident trends. Additionally, all members receive a monthly loss ratio report for the entire pool for the past seven policy years.
